EH Designer Terms of Service

Version 2026-10-03 — data retention period updated.

Back to the application

Important: EH Designer is a design support tool. Generated diagrams, routes, schedules, estimates and files do not constitute a building design or detailed installation design and must be verified by a suitably qualified person before installation.

1. Service provider and contact

The provider and administrator of EH Designer is Cezary Fisz, trading as Energyhouse, ul. Mickiewicza 16, 01-517 Warszawa, NIP (Polish tax ID) 5252408051, email: cfisz@energyhouse.com.pl, hereinafter the “Service Provider”.

2. Definitions and scope of the service

  1. “Application” means the EH Designer service accessed through a web browser.
  2. “User” means a person who creates an account or uses the Application. Accounts should primarily be used for professional or business purposes.
  3. The service includes creating and storing smart home installation projects, placing devices and routes on floor plans, preparing distribution boards, schedules, estimates and exports.
  4. The Application does not provide the services of an installation designer, expert assessor, electrician, tax adviser or accountant. Its results are proposals requiring independent verification.

3. Technical requirements and account

  1. Use requires an up-to-date browser with JavaScript enabled, an internet connection and an active email address. Some exports may require software that supports PDF, HTML, JSON or spreadsheets.
  2. The User must provide accurate, current information, protect their password and not share their account with unauthorised persons. Suspected account breaches must be reported to the Service Provider without delay.
  3. It is prohibited to provide unlawful content, content that infringes third-party rights or malicious software, or to attempt to bypass security measures or overload the service.
  4. The service agreement is concluded upon successful registration and acceptance of the Terms of Service. The User may terminate it by sending an account deletion request to the Service Provider.

4. Trial period, licence and payments

  1. A new account receives 30 days of free trial access from registration. Each User or entity may use one trial period unless the Service Provider decides otherwise.
  2. After the trial, access requires an active fixed-term or perpetual licence. The scope, price, billing period, taxes and payment method will be presented before purchase.
  3. The licence is non-exclusive, non-transferable and permits use of the Application for its intended purpose. It does not include the right to copy code, resell access, bypass limits or create a competing service using the Application's code or database.
  4. After the licence expires, the Service Provider may block project editing and exports. The User should regularly download their own project copies. Section 11 sets out the rules and deadline for data deletion after the agreement ends.
  5. Provisions concerning consumers and individuals entitled to consumer protection apply to the extent required by mandatory law. Information about the paid service and the right of withdrawal will be provided before purchase.

5. Product data, prices and results

  1. Catalogues, availability, prices, tax rates, product specifications, manufacturer documentation and integrations may change. The Service Provider takes care to update them but does not guarantee the completeness or currency of external data.
  2. Before submitting a quote, placing an order, carrying out or accepting an installation, the User must check, in particular, prices, taxes, compatibility, current-carrying capacity, conductor cross-sections, protective devices, addressing, input and output counts, and compliance with manufacturer documentation and applicable standards.
  3. Automatic placement of devices and selection of modules, routes and terminals may require manual correction. Exports to Odoo or another system must be checked before import and approval.

6. Projects, backups and availability

  1. The Service Provider maintains technical backups, but these do not replace the User's own copies. The User should download project files after significant changes.
  2. The service may be temporarily unavailable due to maintenance, updates, failures, security threats or events beyond the Service Provider's reasonable control. Planned work will be announced where possible.
  3. The person sharing a project is responsible for choosing recipients and their permissions. Actions by people granted access by the User are considered actions within the permissions granted.

7. Copyright

  1. Rights to the Application, its code, interface and database elements belong to the Service Provider or the relevant licensors.
  2. The User retains the rights to content they provide. They grant the Service Provider a non-exclusive, royalty-free licence to the extent necessary to host, copy, secure and display that content for the purpose of providing the service.
  3. The User confirms that they have the right to use uploaded floor plans, photographs, customer data and other materials.

8. Liability

  1. The User is responsible for design, quoting, purchasing and installation decisions, and for having the results verified by a person with the required qualifications.
  2. The Service Provider is liable under mandatory applicable law. Nothing excludes liability for intentional harm or rights that cannot lawfully be limited.
  3. In dealings with a User acting as a business, to the extent permitted by law, the Service Provider is not liable for lost profits, indirect losses, installation decisions, incorrect data entered by the User or data from manufacturers and other entities. Total contractual liability for ordinary negligence is limited to the net fees paid for the last three months, or PLN 100 during a free period.
  4. The above limitations do not apply to consumers or persons entitled to consumer protection where they would conflict with mandatory law.

9. Complaints and termination

  1. Complaints may be sent to cfisz@energyhouse.com.pl, including account details, a description of the problem, the date of the event and the requested resolution. A response will be provided without undue delay, normally within 14 days.
  2. The Service Provider may suspend an account for a breach of the Terms of Service, a security threat, non-payment or a legal obligation. Where the nature of the breach allows, the Service Provider will first request that it be remedied.
  3. The User may stop using the service and request account deletion. Termination does not waive amounts already owed.

10. Changes to the Terms of Service and governing law

  1. The Service Provider may change the Terms of Service for significant reasons: changes in law, features, security, the charging model or infrastructure. The User will be informed of changes requiring renewed acceptance before they take effect.
  2. The agreement is governed by Polish law. In disputes with a business, the court with jurisdiction over the Service Provider's registered office is competent; this does not limit statutory court jurisdiction or consumer rights.

Privacy Policy and GDPR information

This forms an integral part of the information on using EH Designer.

11. Data controller, purposes and legal bases

  1. The controller of account data is the Service Provider identified in Section 1. Contact for data matters: cfisz@energyhouse.com.pl.
  2. Data is processed to enter into and perform the agreement and to manage accounts, projects, licences, payments, complaints and security under Article 6(1)(b) of the GDPR; to fulfil tax and accounting obligations under point (c); and to protect claims, prevent abuse, maintain technical statistics and develop the service based on the legitimate interest under point (f).
  3. The data may include name, company, tax ID, address, email, telephone number, sign-in details, licence information, the date and version of accepted documents, security logs, IP address and billing details.
  4. Providing the data required by the form is necessary to create and manage an account. Other data is optional but may be needed in generated documents.

12. Recipients, transfers and retention

  1. Data may be received by authorised associates and providers of hosting, backups, email, IT support, payment and accounting services, solely to the extent needed to provide the service or fulfil a legal obligation.
  2. If a provider processes data outside the EEA, the transfer will take place only under a mechanism provided for by the GDPR, particularly an adequacy decision or standard contractual clauses.
  3. Account data and projects owned by the account are retained while access is valid and for 24 calendar months after it expires, including after a trial. Signing in alone does not extend this period; renewing or extending access sets a new deadline. Before deletion, we send warnings to the account email address at least 30 and 7 days in advance, explaining how to retain the data by renewing access and how to obtain an export by contacting support. Deletion covers the account, its own projects, their versions, associated files and conversation history; it does not delete projects owned by other users. Active accounts and accounts with perpetual access are not subject to this procedure. Outstanding balances, orders or justified holds require separate consideration. After deletion, data is removed from active systems; rotating backups expire according to their schedule. Accounting data and data needed for claims are retained for the legally required period or until claims become time-barred.

13. Individual rights

Data subjects have the right to access, rectification, erasure, restriction, data portability, objection to processing based on legitimate interest, and to lodge a complaint with the President of the Polish Personal Data Protection Office. Where processing is exceptionally based on consent, consent may be withdrawn without affecting prior processing. Data is not used to make decisions producing legal effects solely by automated means.

14. Processing personal data contained in projects

  1. If the User includes personal data of clients or other people in a project, the User remains its controller and the Service Provider processes it as a processor, solely to host, secure, display, export and share the project in accordance with the User's instructions.
  2. Processing continues for as long as the project is maintained and covers identification and contact details, the installation address and other data entered by the User concerning clients, employees, contractors or associates.
  3. The Service Provider undertakes to maintain confidentiality, apply appropriate technical and organisational measures, assist with individuals' rights and breach-related obligations, delete or return data after the service ends, and provide information reasonably necessary to demonstrate compliance.
  4. The User authorises the Service Provider to use subprocessors needed for hosting, backups and service maintenance. The Service Provider will impose data protection obligations no less stringent on them and inform the User of significant changes, allowing a reasoned objection.
  5. The User is responsible for the lawful collection of data, compliance with information obligations and the scope of processing instructions. Special categories of personal data and data unnecessary for the project should not be entered into the Application.

15. Security

Measures include access controls, cryptographically hashed passwords, separation of projects according to permissions, backups and updates. No system guarantees complete security; the User should use a unique password and limit project data to what is necessary.

16. Cookies, analytics and advertising

Essential cookies support sign-in and security. Optional Google Analytics measures visits, traffic sources, engagement time and actions such as registration, opening a project and exporting a document. For signed-in accounts, we use a pseudonymous identifier to link activity across sessions. We do not send names, email addresses, project names, investor details or floor plan content to Analytics.

Consent to analytics does not include advertising. Choosing “Accept analytics and advertising” additionally allows activity data to be used in Google Analytics, Google Ads and Meta (Facebook and Instagram) to measure registrations, create audiences and personalise advertising. Meta Pixel sends page visit and completed registration events, browser technical data and IP addresses. We do not send project names, investor details or floor plan content to Meta; automatic matching of form data is disabled. Refusing consent does not restrict account features. Your choice is saved in this browser and can be changed or withdrawn using “Cookie settings” in the application.
